A former Richmond County Sheriff’s Office investigator arrested for sexual assault in November was indicted on a rape charge.

A Columbia County Grand Jury indicted David Timothy Dutton, of Keene Street in Martinez, for rape, aggravated sexual battery, unlawful surveillance and giving false information, according to records released Thursday.

A 27-year-old woman told Columbia County authorities on Nov. 12 that she was looking through Dutton’s phone and found videos of them having sex the previous night, according to a Columbia County Sheriff’s Office incident report. The woman said she wasn’t aware she had sex or that it was filmed.

The woman said she took her prescription medication and went to sleep and has no recollection of the sexual encounter, according to the report.

Dutton initially told deputies that the woman, dressed in black lingerie, consented. He admitted recording the encounter without her knowledge, according to the report. Dutton erased the videos and pictures after he took the phone back.

Dutton, who was initially suspended from the Richmond County Sheriff’s Office pending a review of his case, resigned on Nov. 26, according to Lt. Calvin Chew.

More to the story

There is more to this story than is being reported. What would you possibly take that would render you so unconscious that you wouldn't know someone was penetrating you? And why would she be dressed in lingerie?

Obviously, video capturing this was a stupid and horrible thing to do, but the story just doesn't seem right.

Yeah, there has to be more to this story. Was she @ his place, or was he @ her place? Her state of dress does not make sense, and this be called rape. We'll have to wait for more to come out @ trial.

Sleeping Meds-Rape

The commercial with the butterfly is the one that has been known to place the user in such a deep sleep and its been reported as a side effect that some even drive; cook; clean and have no memory of it whatsoever; so I don't doubt she would have no recollection. What I find interestingly stupid is a cop videoing the encounter? What kind of a brainiac does this?

AMBIEN and can't we just leave them alone and let them draw their salaries. Diddle around for recreation. Drive batmobiles. Carry high capacity magazines. They are just flawed human beings like the rest of us. Should we expect them to be some sort of role models? Special people who we can trust with our lives? They ain't Sargent York or Audie Murphy.

They just do or don't do a job. The only difference is that we "pay their salaries" but have no say in their lack of performance.

Yep that's right, it was his current wife at the time .That's just plane wrong. The whole thing is BS and it is just pay back from her to him for something ( would your wife or husband do that to you ? ) and Columbia county fell for it hook line and sinker .

No, it is not BS, she was legally unable to consent to sex or to being videorecorded. And it doesn't matter what all of you think, that's the law in Georgia. Because the next question is, why didn't he tell her that he did it? Why did he lie about it to the investigators, if it was all so innocent? And I've heard enough about this to know that what he did to her was deeply disturbing and wrong. If someone did to me all that he is being accused of, I'd bury them under the jail, too. This was not normal in any way, he is perverted.

It is quite possible that, depending on the phone and what social media the former deputy dabbles in, there may be a record of video that still exists even though he may have deleted the record on his phone. Many Android phones can be connected to FB and Google + to automatically upload video and/or still images to their accounts to be shared at a later time.
