Man accused of sucking teen's toes in Grovetown Walmart not charged

Authorities won’t charge a man recently accused of sucking a teen’s toes at the Grovetown Walmart.

An 18-year-old girl said on July 10 that Joey William Leaphart, of Langley, S.C., tricked her into letting him suck her toes inside the store, according to a Columbia County Sheriff’s Office incident report.

Leaphart won’t be charged because the teen consented to the contact, sheriff’s Capt. Steve Morris said.

The teen said she was shopping in the store when a man, later identified as Leaphart, asked if her toenails were painted. After replying yes and questioning why he wanted to know, the teen was asked if she’d watched America’s Funniest Home Videos, according to the report.

The man told her he was with the show and if she complied with his requests, everything she purchased that day would be free. She reluctantly agreed to him taking a picture of her foot.

Leaphart guided her to an area behind a clothing rack, dropped to the floor, grabbed her ankle and said, “Don’t worry. I don’t bite.”

He then started sucking on her big toe. The teen screamed at him to stop and told him to leave.

Before the man ran from the store, he told her, “It tasted so good, though,” according to the report.

Leaphart was previously arrested for similar incidents. He became a registered sex offender in December 2000 when he pleaded guilty to performing a lewd act on a person under 16 for licking the toes of an 11-year-old girl. In 2002, a jury acquitted Leaphart, who was accused of aggravated battery after a 22-year-old woman said he forced himself on her foot.

On Feb. 17, Leaphart was arrested and charged with solicitation for contribution after approaching women in North Augusta Plaza and asking for money, according to the North Augusta Department of Public Safety.

The man was not charged because she gave consent...that doesn't make sense. If he had asked for a kiss and she gave him one but he then proceeded to rape her and/or she pushed him away, would he gotten off because she initially agreed? I thought at any time in any intimate setting, if someone says "no", it means "no" no matter how far along things get. Plus this man is a registered sex offender, so he should have been given something for his intrusion.
